Agenda

8:30 - Registration

9:00 - Special Education Update
Perry Law Firm
Last term, the Supreme Court issued two major special education decisions. Since then, courts have weighed in on the Supreme Court's guidance. Learn how these new special education cases could affect the process and outcome of special education matters in your district. In addition, hear how a recent special education case transpired and how you can be prepared in the event of litigation.

9:45 - Option Enrollment: What Are Your Choices and Obligations?
KSB School Law
The option enrollment laws in Nebraska require decisions at every level of district administration, including the school board.  Yet, it is one of the most common areas of confusion for administrators and boards when crafting legally-compliant policies and weighing option applications.  Whether you're a district with frequent options or not, all boards must have a good, strong option policy and protocol for avoiding legal trouble.  This presentation will cover the legal and practical considerations for every school.

10:30 - Break

10:45 - Student Privacy Issues (Protecting Student Privacy While Using Online Educational Services)
Perry Law Firm
Oftentimes, technology advances faster than the law. In today's schoolhouse, administrators must balance laws enacted decades ago with the new apps, gadgets and technology of today.

11:30 - Alice Through the Smartphone Glass: Social Media and Student Discipline
KSB School Law
Suspensions for retweets.  Expulsions for Snapchat threats.  The very real consequences for student speech that crosses the line into bullying and terroristic threats are in the news, but do you know which consequences apply when?  How are courts looking at these issues?  We will walk through specific cases to look at how state law, the First Amendment, and other legal considerations apply to student speech and conduct online.  We’ll take a broad look at the digital citizenship landscape and how schools are handling social media based speech that effects schools.

12:15 - Lunch

2:15 - Creative Building Approaches
Perry Law Firm
As Nebraska school districts identify and work to address new educational program needs to keep pace with changes in education delivery in the 21st century, many schools are looking to alternative means of financing building construction projects other than the traditional bond issue election method.  This session will explore the construction delivery methods available to school districts (design-bid-build, construction management at risk, and design-build) to construct school buildings in conjunction with the options available to Nebraska school districts to finance building projects, including lease purchase and/or tax anticipation note financing, and a discussion of “public-private” financing arrangements in use in other states.
